Implications of an IVA (Individual Voluntary Arrangements):
- Your property will be protected within an IVA but you may be required to release all or part of any equity during the period of the arrangement by way of a remortgage or a secured loan. We can help with this process at that time.
- Entering into an IVA may adversely affect your credit rating for up to six years from the date of approval.
- Failure to complete the term of an IVA can result in bankruptcy. Be sure you don't commit to paying more than you feel you can afford.
- Creditors don't have to agree to an IVA. At the Creditors Meeting they can vote not to accept your proposal. This is common when one creditor has a large proportion of your total debt. Your insolvency Practitioner can advise on whether this is likely in your case.
- An IVA is recorded on an IVA register (The Individual Insolvency register is a Public Record of Bankruptcies and Individual Voluntary Arrangements). Insolvency Gov UK provide useful additional information re the Register.
- IVA's are advertised in the London or Belfast Gazette (although this is a credit publication and not generally read by the General Public).
- If you were fortunate enough to come into a windfall e.g. win the lottery or receive an inheritance you would be expected to notify your Insolvency Practitioner and put this towards paying-off your debts. The Insolvency Practitioner can help with a 'Full and Final' IVA where a lump sum offer is made in full and final settlement of your debt.
